The UK will double the qualifying period for permanent settlement for most migrants.
Care workers meeting specific criteria retain a distinct pathway. They remain eligible for settlement after five years. This provision carves out an exception within the broader tightening of immigration policy.
All individuals seeking settlement must now meet stringent new criteria. These demands include a spotless criminal record, A-level equivalent spoken English, no debt owed to the taxpayer, and a consistent record of National Insurance contributions.
Most refugees must also satisfy language requirements and clear all outstanding debts. Partners arriving with a principal applicant and children under 18 can settle concurrently, provided they meet all stipulated requirements.
The Home Office estimates approximately a quarter of those who arrived before May 2025 fall into a category requiring a second chance via the new Health and Care visa. The government asserts the care worker route suffered abuse. They claim "rogue" companies sponsored workers for non-existent jobs.
Shabana Mahmood indicated that The care route was subject to significant abuse under the previous Conservative government. Under her initial proposals, lower-qualified workers who arrived on health and social care visas during the 'Boriswave' from 2022 could have faced a 15-year wait for permanent settlement.

The Home Office projects these changes will save billions in benefits. The reforms are expected to significantly reduce the national welfare bill.
For those entering illegally, the penalty for settlement rights is a 10-year delay for those working or studying. It is a 30-year delay for those not. Indefinite Leave to Remain (ILR) grants indefinite living, working, and studying rights in the UK, alongside eligibility for benefits.
Over 200,000 responses flooded the consultation on the initial proposals. The Home Office has granted approximately 200,000 health and care worker visas in the last five years.
